Perhaps just a conversation around her restlessness might be helpful. One middle school teacher I know lets the student sit in the chair any way he wants to as long as he isn't tipping the chair back. It is possible that the young lady is not getting any clear boundaries set at home and that can make the problem worse, so I wouldn't altogether discount what your para has to say. What you haven't told us is, is she on a 504 plan? IEP? What kind of class do you teach and is there a lot of stimulation in the classroom?
