It sounds like the mother needs to be more concerned about her son's behavior. It could very well be a "boys will be boys" issue here if the mom isn't monitering what he is watching, and is buying him toy guns. With the lack of parent attention he may not realize the effects of his behavior because no one has taught him differently. Why is it assumed that the child is a mental case? With a cousin like his he may just be under some bad influence. He may be trying to play games at school like he does at home with his cousin. As far as the writing goes, sounds like he knows that the consequences of Jason's behavior lands him in prison.
I wouldn't be too concerned that you are under any type of real danger from this child, he's just being a kid.
