Have you tried giving him a choice? "You can go to the timeout bench now, or you can go during recess (substitute gym, library, the movie, art class, the field trip etc). Which do you choose?" Sometimes I've found when I give the child two choices, (both of which are fine with me) they feel they have some control, and they make a decision and do it.
