of course a parent has the right to refuse special ed services at any time and there is nothing you can do about it.... I have seen this happen more than once. the parents get it in their mind that their child doesn't need the special services. they move to a new school and with hold information from the new teacher just to prove that the old school was wrong. So be sure to have examples of what the other children are able to do in your class independently and examples of what their child has/hasn't done.... good luck this one may be tricky
