there are non-verbal IQ tests

unfortunately I don't know what they are called....but I do know they exist because they are used with language delayed children....
I do know in my state the law says that the ESL child has to be in the US for 1 year
before any special education testing can be done.

I'm worried that these kids will not prove to be LD on any tests because there would not be any discrepancies showing up but rather just a flat score....they might just test out to be have a very low IQ and that might result in mislabeling of the child. Do you know what I'm trying to say?

Could it be possible that your school is doing

this because they feel the parents won't know their legal rights and would thus be saving the school district $$$$$?

Do you have any parents who would/could make some waves? Is there an organization in your community that helps your ESL population? I know Catholic Social Services works very closely with our Bosnian population and they do know their rights concerning special education, however, the Bosnians as a rule would prefer that their child not receive the services nor be retained. They see it as a negative rather than extra help.
