I would first check with your union or association as to the merits of such an action. Unfortunately I would think in most places being on a sub list does not necessarily give a person an edge in being hired in a district.| Since you are not on any contract with them they can decide to hire those off the list as well. I know the longer you are on a sub list often the harder it is to get a position. There are several factors involved - first the longer you work - the higher you are on the pay scale - this will depend on how they track your sub time. - they often find it hard to find good subs | | so they may not hire from a sub list because they want to keep you on the sub list.It's often not a fair system, but I'm not sure you'd be able to sue them. Plus even if you win, there will be disgruntled people higher up because you took them to court. Chances are they will place you in the worst jobs hoping you'll quit on your own. Or they will look for the first chance to let you go (staff cut-backs) and then you'd be off the sub list as well. This may not happen but it's something to be prepared for if you do go ahead with a suit. Are there other districts nearby you can apply to that you haven't been subbing with. Perhaps you can get on easier with one of them?
