I agree with Cathy-Dee. Speak to the principal or the guidance counselor yourself from the perspective of how you should handle the situation. In this way they are aware of the little girl's state of mind, yet you aren't going against the classroom teacher. It sounds like she needs more counseling whatever the case. The loss of both parents is significant and not easily "gotten over," but this little girl may be stuck in her grief and need assistance to move on.
