I agree that he needs a more immediate concequence, not a whole bunch of warnings. How about next time he is out of his seat for the second time, you can say, "Well, it looks like you need some more practice on how to stay
in your seat during class. Luckily for you I'll be in here during recess and you can practice sitting in your desk then." Then during recess have him sit in a desk facing away from you and with his head down, and do not allow any talking to you or fiddling with things (this negates the desire for attention that he might have from you). 3rd graders hate to miss a recess, so this might
work for you as it has for me. It works in other situations too! Once he sees you are serious about missing recess, he will probably quit it. Good luck with whatever you try.
