What you say makes a lot of sense. I have seen it for myself: The nicer I am at the beginning of the day (as I'm trying to establish rapport and set the tone for the day!) the more they "test" me. It's a catch 22, any way you look at it. I want them to WANT to cooperate and be attentive. I have seen a great deal of improvement (but not perfect) with a positive discipline approach which helps students focus on listening & cooperating to earn 15 minutes of extra recess at the end of the day. This has been more effective than anything I have tried so far (this is my first year.)
