I agree with Donna...In Michigan (or at least in my district) he would also not be allowed to be in the fifth grade at age 13. I think the child needs a full educational evaluation with the possibility of special education services. Possibly this has been done and his parents have refused the services and then your hands are tied. Have your read his cum file?

This is a sad situation and I have no good advice to give you either. Good luck
