I would continually call the parents. If still no response, our principal writes a letter requesting a conference with the parents. It is late for a child to go to bed. I did have a kid who went to bed around that time everyday in first grade. He was fine in class though-never had any problems. I wonder if your child has mono? That would be medical neglect if they don't take him to the Dr. It isn't "normal" for a kid to do that. Have you asked he goes to bed so late? Does he sleep well at night? Does he take a nap after school? If he sleeps all day, he probably isn't tired at night so he would stay up later. I wouldn't let him sleep everyday. iF it was every once in a while I'm fine with it. The nurse should also step in and help.
